Public Agreement (Offer) and Privacy Policy
This document, the provisions of which are set out below, constitutes a public offer and a public agreement, and also contains the Privacy Policy.
In accordance with Articles 633 and 641 of the Civil Code of Ukraine, its terms are the same for all Customers, and the unconditional acceptance of these terms is considered acceptance of this offer by the Customer.
In accordance with Part 2 of Article 642 of the Civil Code of Ukraine, the actions defined in clause 1.4 of this Agreement constitute acceptance of this offer, which is equivalent to entering into a public agreement for the provision of informational services, hereinafter referred to as the "Agreement", under the terms set out below.
Individual Entrepreneur Chernov Oleksii Vasylovych, acting on the basis of data from the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Organizations, registration number — 2010350000000734535, registration date — 25.02.2025, taxpayer registration number: 3040318534, hereinafter referred to as the "Contractor", on the one hand, offers legally capable individuals, hereinafter referred to as the "Customer", to receive services in the manner and under the terms provided by this Agreement.
Definitions
Materials — lectures, speeches, images, audio recordings, videos, presentations and/or other informational materials created by the Contractor or the rights to which have been transferred to the Contractor.
Website — a web page available on the Internet, including the following links: project20393406.tilda.ws, instagram.com/oleksiychernov, instagram.com/oleksiychernov_eng, tiktok.com/@oleksiychernov5, facebook.com/oleksiy.chernov, t.me/oleksiychernov.
Customer — any legally capable individual who wishes to use the Contractor's services and has the technical ability to receive such Services.
Course — an event or series of events during which the Contractor provides the Customer with informational services according to the Contractor's methods.
Personal Data — information or a set of information about an individual who is identified or can be specifically identified.
Service — an informational service consisting of providing access to Materials of an informational nature, provided by the Contractor for payment.
Acceptance — the Customer's full, unconditional and irrevocable consent to enter into this Agreement in full, without signing a written copy of the Agreement.
Platform — a website/service/application to which the Customer receives access using personal access identifiers after payment for the Contractor's Services.
Tariff — the payment amount established by the Contractor for the provision of Services under this Agreement.
1. Subject of the Agreement and General Provisions
1.1. The Contractor provides the Customer with informational services by granting access to the Materials, and the Customer accepts and pays for them at the price indicated on the Website.
1.2. Services are provided remotely via the Internet in the following formats: "MINI-COURSE"; "COURSE" — Tariffs Basic, Standard, Pro.
1.3. The Contractor's Services do not constitute educational activity under the Law of Ukraine "On Education". No final certification is carried out and no educational documents are issued in accordance with state educational standards.
1.4. The Agreement is considered concluded from the moment the Customer performs any of the actions in clause 1.5, which means full and unconditional acceptance.
1.5. The Customer accepts the Agreement by: 1.5.1 placing an order on the Website; 1.5.2 paying for the Services; 1.5.3 ticking the checkbox "I have read and agree to the terms of the Public Agreement (Offer) and Privacy Policy."
1.6–1.15. The Customer must familiarize themselves with the terms before using the Services. Software (Telegram, Instagram, TikTok, YouTube, Tilda, CapCut, VN, Kwiga, Zoom, etc.) and devices (Android 5.0+, iOS 11+, modern Windows/macOS/Linux), Internet ≥ 5 Mbps required. The Contractor is not responsible for technical failures of third parties; temporary unavailability does not constitute grounds for a refund.
2. Cost of Services, Payment Procedure and Terms
2.1. The Customer pays according to the Tariff established by the Contractor and published on the Website. The Contractor reserves the right to change Tariffs.
2.2. Available Services: "MINI-COURSE"; "COURSE" (Basic, Standard, Pro).
2.3. 100% prepayment is required via bank transfer or WayForPay before the Services are provided.
2.4–2.6. By agreement, payment for the "COURSE" may be made in installments (up to 60 calendar days from the first payment) or via a bank.
2.7. A place in the "COURSE" may be reserved by a non-refundable deposit; the remainder is due no later than 3 calendar days before the start.
2.8. All prepayments are deposits and are non-refundable, non-transferable, and not subject to compensation.
2.9–2.14. If payment is not made in the required amount/time, Services will not be provided. Bank/payment system fees are paid by the Customer. Payment is considered made when funds are credited to the Contractor's account.
3. General Terms of Service Provision
3.1. The Contractor's obligation is fulfilled when access to the Materials is provided via a link or credentials sent to the Customer's email, Telegram or other channel.
3.2. Access to the Platform/Materials confirms service provision (Article 11 of the Law of Ukraine "On Electronic Commerce").
3.3–3.13. The Contractor may involve third parties; Services are accepted without additional documents; transferring access to third parties is prohibited; if access is not provided due to technical issues, it is granted within 14 banking days; the Customer waives the right of withdrawal upon payment; access may be revoked for violations; no refunds after access is granted.
4. Terms of "MINI-COURSE"
4.1–4.4. Includes access to Materials on the Platform; access is granted immediately after payment; access is unlimited subject to platform capabilities; no refunds after access is granted.
5. Terms of "COURSE"
5.1–5.11. Includes materials, online meetings and homework depending on the Tariff (Basic, Standard, Pro). Group meetings (Standard) cannot be rescheduled by the Customer; Pro includes individual sessions that can be rescheduled by agreement. Start date and duration are defined by the Contractor. A certificate is issued upon full completion. Access duration: Basic — 1 month, Standard — 3 months, Pro — 6 months. No refunds after access is granted; exceptions may apply for documented health reasons.
6. Restrictions
6.1–6.5. The Contractor may restrict actions that contradict this Agreement. The Customer may not collect information from the Platform/Website, copy or commercially use any part, transfer access credentials, register on behalf of others or obtain personal data of other users.
7. Disclaimer of Warranties and Limitation of Liability
7.1–7.7. Services and Materials are provided "as is" and are informational/advisory. The Contractor does not guarantee specific results (income, employment, skills). The Customer is fully responsible for decisions made based on the Materials. Services are not educational under Ukrainian law. Access = service delivered; chargebacks without prior contact are considered a violation.
8. Intellectual Property Rights
8.1–8.6. All intellectual property belongs to the Contractor. The Customer may not distribute, copy or commercially use Materials and acquires no ownership rights. Materials may be used only for personal, non-commercial purposes. Unauthorized use may result in penalties under Section 9.
9. Liability and Dispute Resolution
9.1. Governed by the substantive law of Ukraine. Disputes are resolved through negotiations; otherwise — in court under the laws of Ukraine.
9.2–9.7. The Contractor may terminate the Agreement without refund for serious violations (false/offensive information, misconduct, IP violation, non-payment, breach of obligations). IP violations result in termination and a fine equivalent to USD 10,000 in UAH. The Contractor is not responsible for third-party platforms. The Agreement is valid indefinitely until termination or full performance.
10. Privacy Policy
10.1–10.7. The Customer consents to processing of personal data (name, phone, email, age, social media, etc.) for communication, service delivery, marketing and feedback. Data is stored as long as necessary and may be shared with service providers. Internet data security is not guaranteed. The Customer has rights under Ukrainian law.
11. Other Terms
11.1–11.4. The Contractor may update the Agreement at any time. Website information may change without notice. The Customer confirms understanding of the course language (Russian). Last updated: February 3, 2026.
